PREAMBLE

From 1 January 2007 it will be a requirement for the Registration for the Use and/or Discharge of Chemicals into the seas of the OSPAR area, for all substances, other than those on the PLONOR list, to have toxicity, bioaccumulation and biodegradation data to allow environmental assessment leading to Authorisation for their use and/or discharge. Previously in some regions of the OSPAR area toxicity of the preparation rather than substances within preparations was allowed. This will mean that much more testing of substances will be required at some considerable expense.

SCOPE

This scheme has the objective of allowing EOSCA Members to share ecotox datasets with one another whilst preserving confidentiality of the source provider. The Scheme will be administered by the Executive Secretary and EOSCA Members participating in the scheme will, if they desire, be able to sign a confidentiality agreement with Briar Technical Services Ltd. The sharing of the data will be done on the basis that the cost of obtaining data will also be shared. The scheme is open to all Members and Associate Members of EOSCA. Whilst primarily in the first instance it is designed to allow the sharing of existing data it is hoped that it will also develop to allow Members to jointly commission testing of substances for which data does not currently exist.

PROCESS

Members wishing to obtain data for substances will notify the EOSCA Executive Secretary that they require data for a particular substance. Ideally this will be by sending a completed proforma by e mail giving details of the substance and the test data being sought.

The Executive Secretary sanitises the request to ensure that its source is not identifiable to recipients and within 2 working days of receiving the request asks Members to notify him if they have any suitable data that they are prepared to share. Members willing to share are asked to make an initial response within 10 working days. Ideally Members will respond by completing the relevant sections of the proforma of the request.

The Executive Secretary attempts to match requests and responses and if a match occurs will start the process of data verification and transfer preserving the source of the data in the process. The Executive Secretary will if required provide a Letter of Access to any Registration Authority indicating the source of the data.

Transfer Costs

It has been agreed between Members that a standards set of transfer fees be payable by the data recipient irrespective of the original cost of obtaining data. These are given below and do not include VAT.

The transfer fee, including the EOSCA administration fee, will be invoiced in £ sterling by Briar Technical Services Ltd to the data recipient. The Company providing the data will invoice Briar Technical Services Ltd in £ Sterling for the amount less the EOSCA administration fee. This arrangement ensures that no EOSCA Member sees cash transactions from which they can infer that data from one Company has been provided to another.
